Athlete & Parents Waiver

Effective Date: June 22, 2026

Required for all athletes and minor athletes. By completing the booking process on Chaperone Performance, you acknowledge that you have read, understand, and agree to all terms of this Waiver. For minor athletes, a parent or legal guardian must complete this waiver on the minor's behalf.

This Athlete & Parents Waiver, Liability Release, and Acknowledgment ("Waiver") is entered into by the user ("Athlete") or, in the case of a minor athlete, by the parent or legal guardian ("Parent/Guardian") on behalf of the minor. By accessing or using the Chaperone Performance platform and booking coaching sessions, you agree to be bound by this Waiver.

1. Acknowledgment of Risk

Athletic coaching and training activities involve inherent and significant physical, psychological, and environmental risks. These include, but are not limited to:

  • Muscle strain, sprains, tears, and overexertion injuries.
  • Fractures, dislocations, and soft-tissue damage.
  • Heat exhaustion, dehydration, and fatigue.
  • Cardiovascular stress and exertion-related events.
  • Contact injuries in partner or team-based activities.
  • Psychological stress related to performance and competition.
  • Injuries resulting from the use of sports equipment or facilities.

You voluntarily and knowingly acknowledge and assume all such risks associated with participation in coaching sessions facilitated through the Chaperone Performance platform.

2. Platform Role

Chaperone Performance operates as a digital marketplace that connects athletes and families with independent, third-party coaches. The platform does not directly employ coaches, deliver coaching services, supervise sessions, or guarantee the quality, safety, or outcomes of any coaching relationship. Coaches on the platform are independent contractors solely responsible for the content and delivery of their services.

Chaperone Performance's role is limited to facilitating bookings, processing payments, and providing communication tools between athletes and coaches. The platform does not assume liability for the actions, omissions, or services of independent coaches.

3. Release of Liability

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Chaperone Performance, its officers, directors, employees, contractors, coaches, affiliates, successors, and assigns (collectively, "Released Parties") from any and all claims, demands, damages, actions, or causes of action — whether known or unknown — arising out of or relating to your participation in coaching sessions, training activities, or other activities facilitated through the platform.

This release includes, but is not limited to, claims arising from:

  • Personal injury, illness, or death sustained during or in connection with sessions.
  • Property damage incurred during or in connection with sessions.
  • The negligence of any Released Party.
  • Any failure of equipment, facilities, or instruction.
  • Actions or omissions of independent coaches on the platform.

This release does not apply to claims arising from gross negligence or intentional misconduct by Chaperone Performance.

4. Medical Acknowledgment

You represent and warrant that:

  • The athlete (or minor athlete) is in adequate physical health to participate in the selected coaching activity.
  • A qualified medical professional has been consulted if there are any pre-existing health conditions, injuries, chronic illnesses, or medical concerns that may be affected by physical training.
  • Any known physical limitations, medical conditions, or dietary restrictions have been disclosed to the coach prior to the first session.
  • You understand that Chaperone Performance does not provide medical advice, and that all coaching content is for training purposes only and is not a substitute for professional medical guidance.

5. Minor Athlete Consent

For athletes between the ages of 13 and 17, the Parent/Guardian hereby grants permission for the minor to participate in coaching sessions, training programs, drills, and activities offered through the Chaperone Performanceplatform. The Parent/Guardian confirms they have the legal authority to provide this consent and agrees to:

  • Accompany or arrange responsible adult supervision for the minor athlete during in-person sessions as appropriate for the child's age and the session format.
  • Ensure the minor athlete is aware of and abides by the platform's community standards and conduct expectations.
  • Keep contact and emergency information accurate and up to date at all times.
  • Monitor the minor's interactions on the platform and take responsibility for their conduct.

Children under the age of 13 are not permitted to use the platform under any circumstances.

6. Communication & Safety

All communication between athletes, parents/guardians, and coaches must take place through the Chaperone Performanceplatform's built-in communication tools. You agree not to share personal contact information (phone numbers, personal email addresses, or social media handles) with coaches, or to solicit or accept off-platform communication. This requirement exists to protect the safety of all users, especially minor athletes.

You agree to report any communication that appears inappropriate, threatening, or in violation of platform policies to Chaperone Performance immediately at info@chaperoneperformance.com.

7. Personal Responsibility

You acknowledge that you are responsible for your own safety and well-being (or the safety of the minor athlete in your care) during coaching sessions. You agree to:

  • Follow the safety instructions of your coach at all times.
  • Stop activity and notify the coach immediately if you experience pain, dizziness, shortness of breath, or any other concerning symptom.
  • Use appropriate gear and equipment for the sport or activity.
  • Ensure the training environment is safe and free of hazards, particularly for remote or in-home sessions.
  • Refrain from engaging in activities that exceed your current fitness level without appropriate guidance.

8. Emergency Medical Authorization

In the event of a medical emergency during a coaching session in which the athlete (or parent/guardian) cannot be reached or cannot respond, you hereby authorize the coach, Chaperone Performance staff, or other qualified individuals present to:

  • Call emergency medical services (911 or local equivalent).
  • Administer or facilitate basic first aid.
  • Authorize emergency medical treatment as deemed necessary by qualified medical personnel to protect the athlete's health and safety.

You agree to maintain accurate and current emergency contact information in your Chaperone Performance account. You are responsible for all medical costs incurred on behalf of yourself or the minor athlete in your care.

9. Content & Media Consent

You grant Chaperone Performance and its authorized coaches the non-exclusive, royalty-free right to photograph, record, or film the athlete during sessions for legitimate coaching, educational, and promotional purposes. This may include use of such materials on the Chaperone Performance website, social media channels, and marketing materials.

If you do NOT consent to the use of photographs or video of yourself or the minor athlete for promotional purposes, you must notify Chaperone Performance in writing at info@chaperoneperformance.com prior to the first session. Internal coaching documentation and session recordings used solely for training feedback are not subject to this opt-out.

10. No Guarantee of Results

Chaperone Performanceand its coaches make no guarantees regarding athletic performance outcomes, skill development timelines, or competitive results. Coaching is an educational and developmental service, and individual results vary based on many factors outside the control of the coach or the platform, including the athlete's effort, physical condition, genetics, and commitment to training.

11. Payment & Subscription Acknowledgment

You acknowledge and agree that:

  • Session and subscription fees are charged as disclosed at the time of booking or enrollment.
  • Cancellations made more than 24 hours before a session are eligible for a full refund; cancellations within 24 hours may incur a fee.
  • No-shows are non-refundable.
  • Subscription plans auto-renew unless cancelled prior to the renewal date.
  • You will not attempt to charge-back legitimate sessions or solicit refunds for services properly rendered.

12. Platform Rights

Chaperone Performance reserves the right to:

  • Modify, suspend, or discontinue any feature of the platform at any time.
  • Remove any athlete, parent/guardian, or coach from the platform who violates these Terms or the platform's community standards.
  • Update this Waiver from time to time, with notice provided via email or on the platform.
  • Use aggregated, de-identified session data to improve platform features and services.

13. Governing Law and Dispute Resolution

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any disputes arising from or related to this Waiver shall first be submitted to good-faith negotiation for a period of 30 days. If unresolved, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) in Broward County, Florida.

You waive any right to bring a class action or participate in a class arbitration. All proceedings shall be conducted on an individual basis.

14. Acknowledgment

BY COMPLETING THE BOOKING PROCESS ON THE CHAPERONE PERFORMANCE PLATFORM, YOU CONFIRM THAT YOU:

  • Have read and understood this entire Waiver.
  • Are the athlete or the parent/legal guardian of the minor athlete and have the authority to enter into this agreement.
  • Voluntarily agree to all terms and conditions stated herein.
  • Acknowledge that this Waiver is legally binding and limits your legal rights.
  • Understand that this Waiver covers risks associated with athletic training and the use of the Chaperone Performance platform.
